Step-by-Step Guide to Filing Form I-140 Online

Why file I-140 online?

  1. Save $50 on I-140 form fee.

  2. Save printing and postage cost. ($100 or more)

  3. Get receipt upon submission.

  4. If RFEed, you can submit RFE response online.

How to file I-140 online?

  1. Click "My Account" - "File a form online"

3. Select "I-140, Immigration Petition for Alien Worker", read instructions in the new page and click "Next".

4. Choose your Petition type

We use NIW as an example.

5. Upload your I-140 form.

Important Notes:

  • Your I-140 PDF must contain all pages, including the signed page 6.

  • Your I-140 PDF must has original barcode on the bottom of every page. Otherwise the online system can not recognzie it correctly.

  • It's better to print, sign on page 6 and scann it to a single page PDF. and then replace page 6 of I-140 with this single page PDF.

6. Upload Evidence Supporting National Interest Waiver

This is the place to upload the full body of your petition (e.g., petition letter, index of exhibits, and exhibits). The system has a 12 MB PDF size limit. If your full petition PDF exceeds 12 MB, you can split it into several smaller PDF files and upload them sequentially.

7. Upload "An official Academic Record"

Ignore instructions, just upload your Diploma.

8. Proof of Exceptional abilities

Only if you need to claim "exceptional abilities"

9. Form ETA-9089

Upload ETA-9089, and signed Final Determiantion here.

10. Form ETA Appendix A.

Upload appendix A here.

11. Form ETA-750/750B

Ignore if you don't need to upload.

12. Additional Evidence

you may upload any other evidences you want to provide here.

13. Review & Submit

Review each of your file to see if it is correctly formatted and displayed.

14. Sign and make the payment!

Then you done!

Note: USCIS will review your submitted forms to see they are correctly filled and signed. If accepted you will receive a receipt from your email. DO CHECK IT TO SEE IF YOUR CASE IS ACCEPTED.
